Questions:

1. Is Vafa eligible for a permanent visa? If so, briefly explain which visa(s) and why the visa(s) would be appropriate for Vafa’s circumstances.

2. If Vafa applies for a visa while she is in Australia as the holder of the Visitor (Subclass 600) visa, which bridging visa would she be eligible for? Would she be able to travel between Australia and Malaysia while she holds this bridging visa?

3. Assume instead that Vafa is a New Zealand citizen and is not the holder of a Visitor (Subclass 600) visa. Would this change your answer to question 1? Your answers should be supported by reference to the relevant legislative provisions of the Migration Act 1958 and Migration Regulations 1994 including relevant policy.
